These Terms of Service govern your access to and use of Nextu and any related features, content, or services we make available. By downloading, installing, accessing, or using the app, you agree to be bound by these Terms. If you do not agree, you must not use the service.
You represent that you have read and understood these Terms and that you have the legal capacity to enter into a binding agreement. If you use Nextu on behalf of another person or entity, you confirm that you are authorized to accept these Terms for that person or entity.
You retain all ownership rights in the photos, images, and other content you import, capture, create, or store through Nextu (“User Content”). We do not claim ownership of your User Content.
To operate the app, you grant us a limited, non-exclusive, revocable, worldwide license to process your User Content solely as needed to provide the service on your device, generate collages or monthly walls, display your timeline, and support local export or sharing features you choose to use. This license is temporary and limited to service operation and does not transfer ownership to us.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use Nextu for your personal, private, non-commercial purposes. This license permits you to use the app’s core recording, timeline, collage, and monthly review functions as intended.
You may not use the app in any manner that exceeds the scope of this license or that interferes with the normal operation of the service, other users’ devices, or third-party rights.
Nextu is a lightweight local photo organization tool designed to help users capture everyday moments, view them in a chronological timeline, create daily collages, and generate monthly review walls. The service is intentionally focused on personal memory keeping and local organization rather than cloud backup, social networking, or AI-driven editing.
The app may allow you to open directly into a camera or photo-selection experience, automatically tag photos with time and date information, group images by day, and generate visual summaries based on photos taken on the same day or within the same month. Certain features may depend on the number of photos available for a given day or month.
Nextu is designed for local use. Photos, timelines, generated collages, and monthly walls are stored on your device unless you choose to export them to your photo library or share them through the operating system. We may also provide settings for clearing local data, managing deletions, and purchasing consumable virtual currency for certain premium generation actions.
The service may include a home timeline view, a camera view, a daily collage preview, a monthly wall view, and a settings area for data management, privacy information, and coin purchases. Feature availability may vary over time as the product evolves.
Any collage, monthly wall, grouping, label, summary, or other output generated by the app is produced automatically based on available content and device-side processing. These results are provided for informational and personal-use purposes only.
We do not guarantee that generated outputs will be complete, error-free, aesthetically consistent, or suitable for any particular purpose. You use and rely on such outputs at your own discretion and risk.
As between you and us, we own all rights, title, and interest in and to the app, including its software, interface design, branding, logos, text, workflows, and underlying technology, except for User Content and third-party materials licensed to us. All rights not expressly granted to you are reserved.
Your use of the app does not give you any ownership interest in Nextu or in any of our trademarks, service marks, or copyrighted materials. You receive only the limited rights described in these Terms.
You agree to defend, indemnify, and hold harmless Nextu, its affiliates, officers, employees, contractors, and agents from and against any claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use of the app; (b) your violation of these Terms; (c) your infringement or misappropriation of any third-party right; or (d) your User Content.
We may control the defense of any matter subject to indemnification, and you agree to cooperate reasonably with our defense and settlement efforts.
You must not use Nextu for any unlawful, fraudulent, abusive, harmful, or deceptive purpose. Prohibited conduct includes, without limitation: attempting to gain unauthorized access; interfering with app operation; circumventing security or usage limits; reverse engineering, decompiling, or disassembling the app except where such restrictions are prohibited by law; using bots, scrapers, or automated tools to access features improperly; and uploading or storing content that is illegal, infringing, defamatory, threatening, obscene, or otherwise objectionable.
You may not use the service to violate any law or third-party right, to distribute malware, to disrupt device functionality, or to misrepresent the app’s outputs as professionally verified or guaranteed results.
You must be at least 17 years old, or the minimum age required in your jurisdiction to consent to these Terms, whichever is higher, and you must have the legal capacity to enter into a binding agreement. If you are using the app under the supervision of a parent, guardian, or other authorized adult, that adult is responsible for your use of the service.
By using the app, you confirm that you meet these eligibility requirements and that your use of the service does not violate any applicable law or policy.
We may update these Terms from time to time to reflect changes in the service, legal requirements, or business practices. When we do, we may revise the effective date or provide notice through the app or by other reasonable means.
If you continue to access or use Nextu after updated Terms become effective, you will be deemed to have accepted the revised Terms. If you do not agree to the changes, you must stop using the app.
Nextu may offer consumable virtual currency, referred to as coins, through Apple in-app purchase mechanisms. Coins are used to unlock certain generation actions, such as creating a daily collage or monthly wall, once any free allowances have been used.
Coins have no cash value, are not legal tender, cannot be exchanged for money, and are non-transferable except where required by law. All purchases are final and non-refundable to the maximum extent permitted by applicable law and Apple’s policies. Unused coins remain tied to the account or device context used for the purchase, subject to platform rules and any technical limitations.
We may change coin pricing, usage amounts, free trial quantities, or generation rules at any time in accordance with applicable law and platform requirements.
You are responsible for the content you capture, select, store, or share through the app and for ensuring that you have the necessary rights to do so. You must keep your device secure, manage access to your photos and local data, and review exports before sharing them with others.
You are also responsible for maintaining sufficient device storage, complying with any applicable laws governing personal data and images, and using the app in a way that respects the privacy and rights of others. We are not responsible for User Content that you choose to keep, delete, export, or share.
To the maximum extent permitted by law, Nextu and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the app.
Our total liability for any claim relating to the app will be limited to the amount you paid to us for the service giving rise to the claim, or, if no such amount was paid, the minimum amount permitted by law.
The app and its features are provided on an “as available” basis. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free, or that any particular feature will always be available on any device or operating system version.
We may modify, suspend, limit, or discontinue any part of the service at any time, with or without notice, including feature availability tied to device compatibility, storage conditions, maintenance, legal compliance, or product changes.
To the fullest extent permitted by law, Nextu is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including any warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the app will meet your expectations, that results will be accurate or complete, or that defects will be corrected. Your use of the app is at your own risk.
You may stop using Nextu at any time by uninstalling the app and ceasing access to the service. You may also use the available data-clearing tools to remove local content from your device, subject to any content that has already been exported outside the app.
We may suspend or terminate your access to the app, in whole or in part, if we reasonably believe that you violated these Terms, engaged in harmful conduct, or created legal, security, or operational risk. Upon termination, the rights granted to you under these Terms will end immediately, except for provisions that by their nature should survive.
These Terms and any dispute arising out of or relating to the app will be governed by and construed in accordance with the applicable laws of the jurisdiction in which the service provider is legally established, without regard to conflict-of-law principles, except where local consumer protection laws require otherwise.
If any dispute resolution or venue rules apply by law, those mandatory rules will control to the extent required.
